Man FINALLY Cleared of Conviction after Three Decades in Jail!
An ex-convict received a monetary award of $1 million by the government of Tennessee when he was found to be innocent of an offense he didn’t commit. The clarification came after a DNA test was conducted 31 years later. His lawyer of six years, David Raybin, called the cash reward a “bitter-sweet” gesture after McKinney was officially cleared from every allegation since January.
In 1978, the 61-year-old man by the name Lawrence McKinney was jailed after being accused of molestation and breaking in, but he regained his freedom 31 years later. The financial remuneration was given to him last Wednesday by the Tennessee Board of Claims.
Emotional Case
Raybin further said that he’d been an attorney for crime-related defenses for four decades, yet he saw this particular case as a very touching one that he’d ever witnessed, among other similar emotionally-draining cases. Working relentlessly for half a dozen years to get fair treatment for a man who had been imprisoned for such a long time, is a neck-breaking task, he said.
The 1978 judgment became an upended one in 2009, and that made the state to compensate McKinney with $1 million. $354,000 are meant to settle the debt for the attorneys, plus a car budget and other debts; then a monthly wage of $3,400 for at least a decade.
In case McKinney loses his life before the completion of the decade, the monthly wage must be automatically transferred to his spouse or his property agent as legitimate replacements. However, $1 million is still not justifiable enough for his suffering, says Raybin.
The activist and legal practitioner corroborated this argument by noting that the highest compensation of $1 million was stipulated a decade ago but, when the present day economic situation is put into consideration, that amount isn’t good enough to cover the new era of financial obligations. Notwithstanding, Raybin believes that McKinney is grateful enough for the way things have turned, even with the insufficient payment.
Perseverance Paid off
When McKinney was freed from jail in 2009, he began another legally torturous journey aiming to get a fair treatment in both, the financial aspect and freedom-wise. He was denied of proper liberation for two times by the board of parole, despite the proofs from the DNA findings that he wasn’t connected to the alleged crime. The proofs were also fully-supported by the district attorney general and Shelby County Criminal Court. Also, says Raybin, the ex-governor of Tennessee, Phil Bredesen, refused to exonerate McKinney when the opportunity to do so arose.
However, last year December, McKinney finally got his much-awaited exoneration from the current serving government, Bill Haslam, who completed every necessary procedure for him, and that enabled him to file for the reward at the state level. A few days later, the governor, Haslam, declared authoritatively that McKinney is not guilty from the legal perspectives. He went ahead to show gratitude to the Board of Parole for its diligent work and approvals, but he declined from previous charges from the court.
One legal NPO known as the Innocence Project that seeks for liberations of innocent convicts, says that some states have no provisions for laws that reward unjustly imprisoned victims, and some of them are Arkansas, Kentucky, Delaware, Oregon, Alaska, Rhode Island, and Idaho. The organization thereafter emphasized the importance of sufficient rewards to be given to innocent convicts as long as they are adjudged guiltless. Most recently-released prisoners usually go back to the society with no loved ones or livelihood sources to run to such as family members, neighbors, insurance, pension, and accommodation.
